The Red (Team) Analysis Society’s website, products and services are provided by The Red (Team) Analysis Society, a company limited by guarantee registered in England and Wales under company number 8722553. These Terms and Conditions (“Terms”) govern your use of The Red (Team) Analysis Society’s website (“Site”), apps, and other products and services (“Services”). As some of our Services may be software that is downloaded to your computer, phone, tablet, or other device, you agree that we may automatically update this software, and that these Terms will apply to such updates. Please read these Terms carefully, and contact us if you have any questions. By using our Site and Services, you agree to be bound by these Terms, including the policies referenced in these Terms (such as our Privacy Policy).
Using The Red (Team) Analysis Society
Who May Use our Services
You may use our Site and Services only if you can form a binding contract with The Red (Team) Analysis Society, and only in compliance with these Terms and all applicable laws. When you create your Red (Team) Analysis Society account, and subsequently when you use certain features, you must provide us with accurate and complete information, and you agree to update your information to keep it accurate and complete. Any use or access by anyone under the age of 16 is prohibited, and certain courses may have additional requirements and/or restrictions.
Our License to You
Subject to these Terms and our policies (including course-specific eligibility requirements and other terms), we grant you a limited, personal, non-exclusive, non-transferable (except in the case you are buying on account of members of your staff, and you provide us with the details of the individuals who will use then the license in agreement with these Terms), revocable license to use our Site and Services. You may download content from our Site and Services only for your personal, non-commercial use, unless you obtain The Red (Team) Analysis Society’s written permission to otherwise use the content. You also agree that you will create, access, and/or use only one user account, and you will not share with any third party access to or access information for your account. Using our Site and Services does not give you ownership of any intellectual property rights in our Site and Services or the content you access.
Our Courses
Course Modifications
While we take pride in our world-class courses, unexpected events do occur. The Red (Team) Analysis Society reserves the right to cancel, interrupt, or reschedule any course or to modify any course content or the point value or weight of any assignment, quiz, or other assessment. Courses offered are subject to the Disclaimers and Limitation of Liability sections below.
No Academic Credit
Unless otherwise explicitly indicated by a credit-granting institution, participation in or completion of a course does not confer any academic credit. Even if credit is awarded by one institution, there is no presumption that other institutions will accept that credit. You agree not to accept credit for completing a course unless you have earned a Course Certificate (or other equivalent of The Red (Team) Analysis Society credential) for that course. The Red (Team) Analysis Society, the course instructors, and the associated participating institutions have no obligation to have a course recognised by any educational institution or accreditation organisation.
Disclaimer of Student-University Relationship
Nothing in these Terms or otherwise with respect to your participation in any course: (a) establishes any relationship between you and any educational institution with which The Red (Team) Analysis Society may be affiliated; (b) enrolls or registers you in any educational institution, or in any course offered by any educational institution; or (c) entitles you to use the resources of any educational institution beyond participation in the course.
Your Content
User Content
The Site and Services enable you to share your content, such as homework, quizzes, exams, projects, and other assignments you submit, posts you make in the forums, and the like (“User Content”), with The Red (Team) Analysis Society, instructors, and/or other users. You retain all intellectual property rights in, and are responsible for, the User Content you share.
How The Red (Team) Analysis Society and Others May Use User Content
To the extent that you provide User Content, you grant The Red (Team) Analysis Society a fully-transferable, royalty-free, perpetual, sublicensable, non-exclusive, worldwide license to copy, distribute, modify, create derivative works based on, publicly perform, publicly display, and otherwise use the User Content. This license includes granting The Red (Team) Analysis Society the right to authorise participating institutions to use User Content with their registered students and on-campus learners independent of the Site and Services. Nothing in these Terms shall restrict other legal rights The Red (Team) Analysis Society may have to User Content, for example under other licenses. We reserve the right to remove or modify User Content for any reason, including User Content that we believe violates these Terms.
Feedback
We welcome your suggestions, ideas, comments, and other feedback regarding the Site and Services (“Feedback”). By submitting any Feedback, you grant us the right to use the Feedback without any restriction or any compensation to you. By accepting your Feedback, The Red (Team) Analysis Society does not waive any rights to use similar or related Feedback previously known to The Red (Team) Analysis Society, developed by its employees or contractors, or obtained from other sources.
Security
We care about the security of our users. While we work to protect the security of your account and related information, The Red (Team) Analysis Society cannot guarantee that unauthorised third parties will not be able to defeat our security measures. Please notify us immediately of any compromise or unauthorised use of your account by emailing contact@redanalysis.org.
Third Party Content
Through the Site and Services, you will have the ability to access and/or use content provided by instructors, other users, and/or other third parties and links to websites and services maintained by third parties. The Red (Team) Analysis Society cannot guarantee that such third party content, in the Site and Services or elsewhere, will be free of material you may find objectionable or otherwise inappropriate or of malware or other contaminants that may harm your computer, mobile device, or any files therein. The Red (Team) Analysis Society disclaims any responsibility or liability related to your access or use of such third party content.
Intellectual Property
All copyright, trade marks, design rights, patents and other intellectual property rights (registered and unregistered) and all content located on this Site, provided through Services (whether paid or not) shall remain vested in The Red (Team) Analysis Society or its licensors (which includes other users). Unless specifically stated in a Creative Commons licence which may be attached to some Red (Team) Analysis Society content – http://creativecommons.org/licenses/by-nc-sa/2.0/uk (“Creative Commons Licence”) – you may not copy, reproduce, republish, disassemble, decompile, reverse engineer, download, post, broadcast, transmit, make available to the public, or otherwise use The Red (Team) Analysis Society content in any way except for your own personal, non-commercial use. Please read the Creative Commons licence in full before downloading or otherwise making use of The Red (Team) Analysis Society content.
You must however read these rights subject to any restrictions on use applying to any content or part of them such as video and photographic images (“Special Restrictions”). If you do not agree to be bound by the Creative Commons Licence or any Special Restriction then you must not use The Red (Team) Analysis Society content made available under these Terms and Conditions.
When using The Red (Team) Analysis Society content you must attribute us and any identified author in accordance with the terms of the Creative Commons Licence.
This Site also contains proprietary materials which are owned by or licensed to The Red (Team) Analysis Society and which are not subject to the Creative Commons licence. These materials which will be identified as “Proprietary” include but are not limited to our logos and trading names, certain photographic and video images, sounding recordings and the design, layout and appearance of and graphics contained within this Site. These proprietary materials are protected by intellectual property rights. Unauthorised use of these proprietary materials may constitute intellectual property infringement.
Education Research
The Red (Team) Analysis Society is committed to advancing the science of learning and teaching, and records of your participation in courses may be used for education research. In the interest of this research, you may be exposed to variations in the course content. Research findings will typically be reported at the aggregate level. Your personal identity will not be publicly disclosed in any research findings without your express consent.
Paid Services
The Red (Team) Analysis Society offers paid Services (e.g. Online Courses) for a fee. Unless otherwise stated, all fees are quoted in British Pounds. You are responsible for paying all fees and applicable taxes in a timely manner with a payment mechanism associated with the applicable paid Services. If your payment method fails or your account is past due, we may collect fees using other collection mechanisms. Fees may vary based on your location and other factors, and the Red (Team) Analysis Society reserves the right to change any fees at any time at its sole discretion. Any change, update, or modification will be effective immediately upon posting through the relevant Services. Refunds may be available for paid Services as described in our Refund Policy.
Modifying and Terminating our Services
We are constantly changing and improving our Site and Services. We may add or remove functions, features, or requirements, and we may suspend or stop a Service altogether. Accordingly, The Red (Team) Analysis Society may terminate your use of any Service for any reason. If your use of a paid Service is terminated, a refund may be available under our Refund Policy. None of The Red (Team) Analysis Society, its participating institutions and instructors, its contributors, sponsors, and other business partners, and their employees, contractors, and other agents (the “The Red (Team) Analysis Society Parties”) shall have any liability to you for any such action. You can stop using our Site and Services at any time, although we’ll be sorry to see you go.

THE SITE AND SERVICES AND ALL INCLUDED CONTENT ARE PROVIDED ON AN “AS IS” BASIS WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS OR IMPLIED. THE RED (TEAM) ANALYSIS SOCIETY PARTIES SPECIFICALLY DISCLAIM ANY AND ALL WARRANTIES AND CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE. THE RED (TEAM) ANALYSIS SOCIETY PARTIES FURTHER DISCLAIM ANY AND ALL LIABILITY RELATED TO YOUR ACCESS OR USE OF THE SITE, SERVICES OR ANY RELATED CONTENT. YOU ACKNOWLEDGE AND AGREE THAT ANY ACCESS TO OR USE OF THE SITE, SERVICES OR SUCH CONTENT IS AT YOUR OWN RISK.
Limitation of Liability
We do not guarantee that:
(a) use of the Site will be compatible with all hardware and software,

YOU ACKNOWLEDGE AND AGREE THAT THE DISCLAIMERS AND THE LIMITATIONS OF LIABILITY SET FORTH IN THIS TERMS OF USE REFLECT A REASONABLE AND FAIR ALLOCATION OF RISK BETWEEN YOU AND THE RED (TEAM) ANALYSIS SOCIETY PARTIES, AND THAT THESE LIMITATIONS ARE AN ESSENTIAL BASIS TO THE RED (TEAM) ANALYSIS SOCIETY’S ABILITY TO MAKE THE SITE AND SERVICES AVAILABLE TO YOU ON AN ECONOMICALLY FEASIBLE BASIS.
We further exclude to the fullest extent permissible by law (please see directly below for more details) all liability for damages and direct, indirect, or consequential loss (all three of which terms include pure economic loss, loss of profits, loss of business, business interruption, depletion of goodwill and like loss) or otherwise incurred by you or any other person or organisation and arising out of or in any way connected with the use of the Services, Site or its content, whether based on contract, tort, strict liability or otherwise.
We do not exclude or limit our liability (if any) to you:
(a) for any breach of obligations arising under section 12 Sale of Goods Act 1979 or section 2 Supply of Goods and Services Act 1982;
(b) for personal injury or death resulting from negligence;

Indemnification
You will defend, indemnify and hold harmless us, The Red (Team) Analysis Parties, our affiliates and our officers, directors, employees and agents from and against any and all claims, liabilities, damages, losses or expenses, including reasonable legal costs, arising out of or in any way connected with any breach by you of these Terms and Conditions.
Interception of emails
The internet is not a secure means of communication. Emails may be intercepted by other people or organisations.
You should not send any communication to us through the Site or by email, in particular which contains personal data (including sensitive personal data) and/or confidential information about you or any other person, unless you accept that any such communication would be sent at your own risk and on the understanding that we would not be liable for any loss that you might suffer as a result (except for losses which cannot be excluded or limited at law, as referred to directly above).
General Terms
Revisions to the Terms
We reserve the right to revise the Terms at our sole discretion at any time. Any revisions to the Terms will be effective immediately upon posting by us. For any material changes to the Terms, we will take reasonable steps to notify you of such changes. In all cases, your continued use of the Site and Services after publication of such changes, with or without notification, constitutes binding acceptance of the revised Terms.
Severability; Waiver
If it turns out that a particular provision of these Terms is not enforceable, this will not affect any other terms. If you do not comply with these Terms, and we do not take immediate action, this does not indicate that we relinquish any rights that we may have (such as taking action in the future).
You are prohibited from using our Sites and Services to share content that:
- Contains illegal content or promotes illegal activities with the intent to commit such activities.
- Contains credible threats or organizes acts of real-world violence. We don’t allow content that creates a genuine risk of physical injury or property damage, credibly threatens people or public safety, or organizes or encourages harm.
- Harrasses others. We encourage commentary about people and matters of public interest, but abusive or otherwise inappropriate content directed at private individuals is not allowed.
- Violates intellectual property, privacy, or other rights. Do not share content that you do not have the right to share, claim content that you did not create as your own, or otherwise infringe or misappropriate someone else’s intellectual property or other rights. Always attribute materials used or quoted by you to the original copyright owner.
- Spams others. Do not share irrelevant or inappropriate advertising, promotional, or solicitation content.
- Otherwise violates The Red (Team) Analysis Society Terms and Conditions. Please note that specific courses may have additional rules and requirements.
You also aren’t allowed to:
- Do anything that violates local, state, national or international law or breaches any of your contractual obligations or fiduciary duties.
- Share your password, let anyone access your account, or do anything that might put your account at risk.
- Attempt to access any other user’s account.
- Reproduce, transfer, sell, resell, or otherwise misuse any content from our Site and Services, unless specifically authorized to do so.
- Access, tamper with, or use non-public areas of our systems, unless specifically authorized to do so.
- Break or circumvent our authentication or security measures or otherwise test the vulnerability of our systems or networks, unless specifically authorized to do so.
- Try to reverse engineer any portion of our Site and Services.
- Try to interfere with any user, host, or network, for example by sending a virus, overloading, spamming, or mail-bombing.
- Use our Site and Services to distribute malware.
- Impersonate or misrepresent your affiliation with any person or entity.
- Encourage or help anyone do any of the things on this list.
Complete Agreement
These Terms and Conditions (including the privacy statement, the refund policy below) contain all the terms and conditions applicable to your use of this Site and Services. Nothing contained on this Site, and in the Services is intended to be, nor should be construed as an offer by us to enter into, a contractual relationship with you or anyone else except on these Terms and Conditions.
Jurisdiction and acceptance of these Terms and Conditions
These Terms and Conditions, and any dispute in relation to the materials available from this Site, and Services, are governed by English law. The English courts have exclusive jurisdiction to settle any disputes which may arise out of or in connection with the Terms and Conditions or use of the Site, and Services.

The Red (Team) Analysis Society Refund Policy
If you are found to be in violation of the Terms and Conditions, you will not be issued a refund or voucher. In addition, if you do not pass or if you otherwise receive an unsatisfactory grade for a course, you will not be issued a refund or voucher, unless you qualify for a refund as set forth below.
For Course Purchases
If you cancel your Course registration for a course, The Red (Team) Analysis Society will offer you a complete refund until 8 days after payment, or until you have completed the first unit, whichever is earlier. If you do not earn your Course Certificate or finish your course training within 180 days, your registration will expire and you will need to pay to re-register for the course.
For Other Paid Services
Except as described in this Refund Policy or as explicitly stated as part of the sign-up process for a Service, The Red (Team) Analysis Society has no obligation to provide refunds or vouchers for any other Services.
